SCOPE OF APPLICATION

These general terms and conditions for sales in the Cafés Baqué online store (hereinafter, the TERMS AND CONDITIONS) govern the commercial and contractual relationships arising between CAFÉS BAQUÉ, S.L.U. (hereinafter, BAQUÉ), holder of Tax ID no. B95445508, with registered office in IURRETA (Bizkaia), Polígono Industrial Santa Apolonia, 2-2, C.P. 48215, and Customer Service telephone number +34 946 215 610 (Customer Service hours: from 8:00 a.m. to 1:00 p.m. and from 2:30 p.m. to 5:30 p.m.), and third parties (hereinafter, the CUSTOMER) who purchase the products offered on the website.

The COMPANY’s activity consists of roasting, production, packaging, and distribution of coffee.

The purchase of Baqué products and products from associated third parties through this website expressly implies that the CUSTOMER acknowledges and accepts these TERMS AND CONDITIONS without any reservations. These TERMS AND CONDITIONS may be printed once the contract is formalized through order confirmation.

STORE OPERATION

The procedures required to purchase the products offered and/or to receive services are those described in these TERMS AND CONDITIONS, as well as any specific instructions displayed on the screen during the purchase process.

a. Registration. Registration is not required to purchase products or access certain services through this website. However, it will always be necessary to provide the requested information at the time of completing the purchase.

The CUSTOMER undertakes to provide accurate and truthful information for the mandatory data requested, which are necessary for the fulfillment and execution of this contractual relationship.

Likewise, the CUSTOMER undertakes to carefully safeguard their access credentials (username and password) and not disclose them to third parties. BAQUÉ shall not be held liable for any fraudulent use of the password or identification data, nor for any damages that may result therefrom.

At the time the CUSTOMER registers, their personal and address data, as well as payment-related information, will be incorporated into our database and used solely to process the order and to send information about offers, services, and discounts that may be of interest.

At any time, the CUSTOMER may access, modify, or cancel their registration by sending an email to baque@baque.com.

b. Order. To proceed with a purchase, the CUSTOMER must add the product to their cart following the instructions indicated on the page and complete the order form displayed.

Once the order has been confirmed by the CUSTOMER, BAQUÉ will send an order confirmation email to the email address provided, detailing the characteristics of the transaction carried out.

The CUSTOMER may consult their account to view orders and corresponding invoices, as well as check the status of their order at any time.

BAQUÉ informs that the products and services offered on this website are intended exclusively for delivery within mainland Spain. Therefore, the Balearic Islands, Canary Islands, Ceuta, Melilla, and any delivery outside the indicated geographical area are excluded.

PRICE AND SHIPPING COSTS

The price of the PRODUCTS is the one shown on the website at the time the order is placed. It includes VAT and other applicable indirect taxes.

Offers and promotions will be clearly identified as such, indicating both the previous price and the promotional price.

Shipping costs are not included in the product price and will be displayed before completing the purchase, depending on the total amount of each order.

Shipping costs will also be listed separately in the order confirmation sent by BAQUÉ.

BAQUÉ reserves the right to modify product prices and shipping costs at any time. Any such modification will be clearly visible on the website. In any case, changes to product prices or shipping costs will not apply to orders placed by the CUSTOMER and confirmed by BAQUÉ prior to the modification.

DELIVERY METHOD AND TIMEFRAME

All confirmed orders will be delivered to the delivery address provided by the CUSTOMER.

Delivery times range from 1 to 4 business days from receipt of the shipping confirmation email and are subject to product availability and the delivery area.

There will be no dispatch or delivery of orders on Saturdays, Sundays, or public holidays. The daily order cut-off time is 1:00 p.m. on the last business day prior to dispatch.

An order is considered delivered when the courier delivers the package(s) to the CUSTOMER and the CUSTOMER signs the delivery receipt. The courier company will make up to two delivery attempts.

VERIFICATION OF GOODS

It is the CUSTOMER’s responsibility to verify the quantity and condition of the goods.

If, at the time of delivery, any visible damage to the packaging or the product itself is detected, the CUSTOMER must note this on the delivery slip signed with the courier and contact BAQUÉ by sending an email to baque@baque.com or by calling BAQUÉ Customer Service at +34 946 215 610 within 24 hours of receiving the goods.

PAYMENT METHODS

The website uses SSL security protocols and bank details are entered into a secure gateway external to the company.

Payment may be made by credit or debit card. The card will be charged at the time the order is placed.

Payment can also be made via credit card, Bizum, Pay Pal or bank transfer.

PayPal: The CUSTOMER will be redirected to the PayPal website to use its secure payment platform. Once the payment process is completed, the CUSTOMER will be redirected back to the online store.

Credit card (REDSYS): When selecting this option, the CUSTOMER will be redirected to the Redsys payment gateway. No card data are stored on our servers, ensuring 100% secure payments.

Cash on delivery: When selecting this option, payment must be made in cash and with the exact amount at the time of delivery. This option carries an additional surcharge, which will be shown in the final price.

MODIFICATIONS AND UPDATES

BAQUÉ may modify these TERMS AND CONDITIONS, as well as any specific conditions that may apply, at any time and without prior notice. Such modifications will be published on the website so that they may be known to CUSTOMERS, and the date of modification will be recorded.

COFFEE MACHINE WARRANTY

XIAOMI and CECOTEC coffee machines come with a 2-year warranty from the date of purchase. In the event of an issue with a Xiaomi machine, the CUSTOMER should contact Cafés Baqué Customer Service. In the case of an issue with a Cecotec machine, the CUSTOMER must contact Cecotec directly at https://support.storececotec.com/.

CANCELLATION OR WITHDRAWAL AND CONSUMERS’ RIGHT OF WITHDRAWAL

The CUSTOMER may cancel the order free of charge until the moment the email confirming shipment of the order is received.

To do so, the CUSTOMER must notify BAQUÉ within the established timeframe by calling +34 946 215 610 during Customer Service hours: from 8:00 a.m. to 1:00 p.m. and from 2:30 p.m. to 5:30 p.m.

Cafés Baqué will accept product returns within the first 14 business days from the date the CUSTOMER receives the goods, provided that the conditions established by Law 47/2002, regulating commercial activity, are met.

In the case of coffee, being a perishable product, we have an exception to the return policy since these products can deteriorate or expire quickly; however, a refund is guaranteed if the product arrives damaged, subject to prior authorization from Baqué.

As coffee is a perishable product, it is subject to an exception to the right of withdrawal, as such products may deteriorate or expire quickly. Nevertheless, returns are guaranteed if the product arrives damaged, subject to prior authorization by Baqué.

Only returns previously authorized by Cafés Baqué and duly notified will be accepted. To request authorization, the CUSTOMER must contact Cafés Baqué by phone at +34 946 215 610 during Customer Service hours, from Monday to Friday, from 8:00 a.m. to 1:00 p.m. and from 2:30 p.m. to 5:30 p.m.

Once authorized, the CUSTOMER will be informed of the return shipping address and the conditions under which the return will be accepted.

The goods must be returned in their original packaging, in perfect condition, and adequately protected so that they are not received with transport seals or adhesive tapes.

The goods must be received at our warehouse within 14 business days following acceptance of the return. If they are not received within this period, the return will be rejected.

For returned products that comply with the above conditions, Cafés Baqué will refund the CUSTOMER the amounts actually paid within a maximum period of 14 business days from receipt of the products.

Refunds will be issued using the same payment method used by the CUSTOMER.

To return goods to our facilities, the CUSTOMER must arrange the return with a transport service of their choice and bear the shipping costs.

In the case of full returns (where all items in an order are returned), Cafés Baqué will refund both the product amount and the shipping costs, if these were paid.

In the case of partial returns (where only some items from an order are returned), Cafés Baqué will refund only the amount corresponding to the returned products. Shipping costs will not be refunded if they were paid.
